NOW of NY: Again, Allegations of DV Mean Elected Official Must Resign
---------------------------------------------------------------------

April 2nd, 2010 by Robert Franklin, Esq.
They're at it again. The New York state chapter of NOW and its
president, Marcia Pappas are loudly demanding that an elected official
who's been charged with - but not convicted of - domestic violence,
resign his office. And once again, what they ignore are a couple of
minor technicalities called 'democracy' and 'due process of law.' Read
about it here (The Journal News, 4/2/10).

In this case, it's the mayor of White Plains, New York, Adam Bradley,
who's in feminists' crosshairs. His wife made a statement to police
back in February that he'd slammed her hand in a car door. She later
said he'd tossed hot tea on her in January. Out of those incidents,
prosecutors have come up with five misdemeanor charges against
Bradley.
Well, I wasn't there, so I don't know what, if anything, happened.
Come to think of it, Marcia Pappas wasn't there either, so the only
information she has is what she reads in the papers, just like me.
Apart from clearly and unequivocally stating his innocence, Bradley
has, on his attorney's advice, refused all comment on the allegations.
So what we and Pappas know is one side of the story - allegations of
DV by his wife, Fumiko Bradley contained in her statements to police
and which are denied by the accused.

And speaking of the alleged victim, she says she wants the charges
dropped and will not cooperate with the prosecution, but the District
Attorney is unwilling to do that.
For his part, Mayor Bradley says he's got witnesses to back up his
claims of innocence. The Assistant DA offered him a deal in exchange
for his attending Duluth Model DV classes. He turned her down.

In short, what we have to date are naked allegations of DV against an
elected official and nothing more. But as seems to be invariably the
case, for NOW and Pappas, that's all it should take to deny to the
people of White Plains their choice of mayor. A trial proving guilt
isn't necessary. Even hearing Adam Bradley's side of the story isn't
necessary. His unequivocal assertion of innocence is irrelevant. An
election in which the people decide for themselves what they think of
his behavior is an empty exercise.
No, as in the past, democracy and due process of law, including the
presumption of innocence, are mere trifles to the true believers at
NOW. They believe the woman, and what more need be done? For them,
when it comes to domestic violence, the slightest allegations by a
woman against a man trump all else. Even allegations that the alleged
victim herself doesn't support are sufficient to NOW's purposes to
sweep away hundreds of years of hard-won freedoms. Magna Carta? Never
heard of it.

For his part, Adam Bradley is doing exactly what he ought to do -
performing his mayoral duties, clearly asserting his innocence and
otherwise keeping silent until trial time. That may come in as little
as two weeks and then the rest of us, including Marcia Pappas, will
know what actually happened between Adam and Fumiko Bradley. An
impartial jury will decide his guilt or innocence and his rightful
punishment, if any. Afterward, the people of White Plains will decide
whether he should remain in office or not.
But Marcia Pappas and NOW of New York want no part of that. Democracy
and due process of law are not for them. They prefer the power of the
absolute sovereign, the tilt of whose thumb decides the fate of
individuals and multitudes. We should all look long and hard at these
people and understand exactly what they stand for.

Letter to the Editor: Public Opinion Mobs Don't Decide What's Best for
a Marriage
----------------------------------------------------------------------
April 2nd, 2010 by Robert Franklin, Esq.

This letter is in response to the blog post Dedicated Stepmom Sandra
Bullock Deserves Better.
It's not for the public opinion mobs to decide what's best for a
marriage. Public opinion hounds are known for being thoughtless in
their advocacies, always calling for the marriage or the relationship
to be dissolved leaving shattered lives of children and their parents
asunder. I have consistently advocated that the publicly adopted model
for these cases be the Clintons. I hope the public commentators who so
easily advocate the destruction of a rare and cherished relationship
die in their own seats rather than destroy another precious family
where wife and husband know better than to be swayed by divorce
lawyers or divorce industry created media to end their rare and
magical relationship. I am very proud that despite all those public
pressure minions the Tiger Woods, the Jack and Jackie Kennedys and
thousands of other precious couples have not succumbed to the
advocates of family destruction and stuck with their marriages.

April 7th Conference on Male Studies at Wagner College - Be There!
------------------------------------------------------------------

April 2nd, 2010 by Robert Franklin, Esq.
On April 7th, there will be a conference at Wagner College in New
York. The subject is the new academic discipline of Male Studies. Its
aim is to begin to formulate and establish Male Studies programs on
college campuses throughout the nation and the world. Here is the
website for the conference.

I urge you all to attend. The cost is only $25 and you may attend
either online or by telephone as well as in person of course. Speakers
include a Who's Who of men's and fathers' rights advocates in academia
including Christina Hoff Sommers and Katherine Young and Paul
Nathanson of McGill University, authors of Spreading Misandry and
Legalizing Misandry. The conference is only two hours long, but
promises to be stimulating at the very least. Attendees from four
continents and 62 countries will be there either remotely or in
person.
I spoke with conference chair, Dr. Edward Stephens, MD about the
conference and what he hoped it would accomplish. Well, at least the
man doesn't think small. He said he hopes the conference begins a
"revolution in the way we think about males."

Obviously, since the topic is Male Studies, its focus is on academia
which plays a big part in driving public policy. Stephens pointed out
that to date, only one gender has been represented in making policies
related to the sexes. Therefore, for example, when it comes to
domestic violence, Congress hears a lot from those who claim that men
do the vast majority of the DV, and little-to-nothing from those who
point to the science that proves that not to be the case. To get the
attention of legislators at all levels, a critical mass of academic
work must be done in all fields that bends the arc of public
discourse.
The same is true of the media. They too need to be exposed to more
than just the crying in the wilderness of a few bloggers and men's
rights organizations. They need to be exposed to concepts of boys, men
and masculinity that aren't produced by the enemies thereof. When
journalists have been exposed in college, not solely to a feminist
perspective on men, but to a science-based, ideologically-neutral
curriculum on the subject, we'll start to see a more even-handed
treatment of the many topics that impinge on men and boys as males.

So academia is vital to popular conceptions of boys and men, and
that's what Male Studies is about. To date, there are a fair number of
courses on various campuses that broach the topic, but they're
scattered and poorly integrated if at all. Stephens told me that he's
researched the course catalogues for Women's Studies and its more
recent incarnation, Gender Studies, and found no change in what's
being taught. The notion that Gender Studies in any way treats topics
related to men and boys either fairly or even-handedly is "a fraud"
Stephens said.
In addition, the conference will announce the formation of a
foundation for the advancement of Male Studies. Stephens said that his
research indicates that there is some $2.9 billion yearly given by
foundations to programs for women and girls. The foundation to be
announced April 7th aims to begin to reduce the gap between programs
that study and assist women and girls and those that do the same for
men and boys.

For far too long, men have allowed themselves to be described, and in
the process, demonized by ideological feminists who've made no secret
of their misandry. Male Studies at the college level are necessary to
right the many wrong notions that have grown out of ideological
feminism.
The conference on April 7th is a needed first step in that direction.
I hope you can attend.

Update: Logan McQueary Awarded Custody of Still-Missing Son
-----------------------------------------------------------

April 1st, 2010 by Robert Franklin, Esq.
A lot has happened since I last posted anything on the Baby Gabriel
case. A lot and not very much. Back in late December, Logan McQueary
and Elizabeth Johnson were embroiled in a custody battle over their
son Gabriel who was then nine months old. Johnson took the child to
San Antonio, where he disappeared. She then went on to Florida where
she was arrested, returned to Arizona and charged with a variety of
criminal offenses including kidnapping and custody interference.
McQueary had been given temporary custody by the judge in the custody
case and Johnson had texted him that she had killed the baby. Now he's
been given full custody of his missing son. Read about it here (Arizona
Republic, 3/26/10).

Since then, police in San Antonio made a very belated effort to search
a landfill for the baby's body, but found nothing. Few people still
believe that Johnson was telling the truth about killing the child.
Also, Tammi Smith, a friend of Johnson, has also been indicted on
lesser offenses stemming from her assistance in depriving McQueary of
custody.

Nationally reputed private investigator and serial spotlight grabber
Jay J. Armes spent a few weeks investigating the case until he was
asked to leave by McQueary's attorney. The current PI says he doubts
that Gabriel was adopted by parents "under the table," but rather
thinks that the boy is with someone who has promised to keep him
secret.
Johnson remains in jail. She once refused to attend court in her
criminal case. The judge instructed bailiffs to bring her to the next
hearing by any means necessary. She's attended subsequent hearings
including the one in which McQueary was granted custody. She took the
stand, but refused to answer questions citing her 5th Amendment
privilege against self-incrimination. McQueary's attorney has asked
the judge to hold Johnson in contempt of court for interfering with
McQueary's custody by removing the child. That hearing is set for
April.

Meanwhile, forensic psychologist Dr. Erin Nelson viewed a videotape of
the custody hearing and said here that Johnson is not particularly
concerned about her son and that she puts her own interests before his
(KPHO, 3/26/10). That, of course is entirely in keeping with her
behavior to date. Prior to taking Gabriel to Texas, she'd told
McQueary that she didn't want the baby and didn't want McQueary to
have him either. In short, her kidnapping of the boy served her
interests alone.
Second, Nelson said that Johnson's refusal to divulge the child's
whereabouts,

could be a way for Johnson to retain control over the situation.
"For certain people, just that level of control can be
intoxicating,” she said. “To have people all over the world
hanging on your word, that's a pretty powerful place to be and
that could a feeling she's not ready to relinquish.”

That too fits her other actions regarding Gabriel and his father -
control. And, as I've pointed out before, it's a recurring theme in
custody matters. Some mothers will tolerate nothing less than complete
control when it comes to their children. Maternal gatekeeping is the
obvious expression of that, as is kidnapping, visitation interference,
and even murder. And certainly that's true of Elizabeth Johnson. She
decided she didn't want Gabriel and what she's done after that
decision has indicated in no uncertain terms that her way was the only
way. She continues that behavior to this very minute and seems willing
to go to prison for the privilege.

The Education of a Psychologist: 'Political Correctness More Important
than Data'
----------------------------------------------------------------------
April 1st, 2010 by Robert Franklin, Esq.

Ah, comes the dawn!
This piece by Mark Sherman, PhD. is entitled "Boys and Young Men: A
New Cause for Liberals," but it's more about Sherman's growing
awareness of the gap between what liberals say and what they do when
it comes to males - particularly boys (Psychology Today, 3/29/10).
Sherman introduces the subject this way:

I'm a liberal, but my primary professional allegiance is to the
truth, especially as expressed by solid data.
And that's the nut of his problem - the collision between political
persuasion and data.

His article is about education. Sherman is a psychologist and he's
read the data about boys' and girls' achievements in school. He's
studied the matter over a couple of decades and has seen the steady
relative decline in boys' academic performance. As I've written
recently, analyses of educational data now pretty clearly show that
girls have closed the math gap with boys, but an enormous gulf still
yawns between the sexes in reading.
That's scarcely news. The data have been trending that way at least
since the early 1990s, and Sherman describes his astonishment when,

I went to a conference in 1994 where David Sadker, coauthor of the
then newly published Failing at Fairness: How America's Schools
Cheat Girls, was the keynote speaker, and I raised my hand to say
that I was confused, since the data was showing that it was boys
who were having more trouble in school than girls. I was derided
by Sadker and given no support whatever from anyone else in the
audience of a hundred.
Am I crazy, I thought? Is there something I don't know?

No, I wasn't crazy, but there was something I didn't know. I
didn't know that when it came to gender issues, political
correctness was more important than data.
In short, there's that collision again - the one between science and
belief.

(As an aside, David Sadker at the time of the conference was receiving
funding from the Women's Educational Equity Act which also funded the
NOW Legal Defense and Education Fund. The astoundingly shoddy research
produced by him, and others funded by the WEEA has been detailed by
Christina Hoff Sommers in her book The War Against Boys. Among other
things, Sadker at one point claimed that boys in primary schools "call
out" answers eight times more often than do girls. But when a reporter
asked him for his research, mysteriously, neither he nor the
organization that sponsored it had a copy. Apparently no one has ever
seen it and Sadker later admitted the figure to be "inaccurate."
Education maven Carol Gilligan did the same thing; she claimed she had
research showing that girls were at a disadvantage in education, but
when asked numerous times over many months to produce it, never did.)
What Sherman presents as a dilemma for him - how to remain a liberal
and yet maintain his scientific respect for accurate data - really is
not. After all, it's nowhere etched in stone that a liberal can't go
to bat for men, fathers or boys. Indeed, we do it every day. One of
the key tenets of liberalism is helping the downtrodden, whoever that
may be. So if that happens to be fathers in family courts or boys in
schools, it's perfectly consistent with liberal values to give them
support. I would argue that it's required.

And what about gender equality? Liberals shout long and loudly their
support for equality of the sexes, so again, if boys are doing worse
in school than girls, then sticking up for them is just good
old-fashioned liberalism.
But somehow Sherman doesn't quite get it. He knows the truth - boys
need help in school - but he has trouble facing his fellow liberals
and demanding that they mean what they say. His solution is for them
to read a book on boys' lagging in schools. Well, I'm all for that,
but he should read his own article. Liberals aren't stupid; it's not
lack of information that's the problem. As is so often the case, many
liberals have constructed a mythology of male evil and female virtue,
and aren't about to let data confuse the narrative.

So it's no surprise when the New York Times runs this article about
the new data on math and reading test results without ever mentioning
that the reason why scores are improving in math is because girls are
improving there or that the reason why reading scores are not
improving is because boys aren't improving in that area (New York
Times, 3/24/10). You'd think it would be impossible to ignore that,
but the writer managed. I believe he did because to do otherwise would
be to interrupt the worldview of male privilege that's consistently
promoted by the Times and other liberal publications.
Nor is it a surprise to read Nicholas Kristof of the Times claiming
that the phenomenon of poor male performance in schools recently
"snuck up" on us. As Sherman rightly points out, it did no such thing.
We've known it for 20 years, but when your mindset doesn't allow for
the concept that males too suffer inequalities, I can see how even
well-known facts that contradict that mindset might well "sneak up" on
you.

I'm a liberal myself and have been for 40 years or so, and I, like
Sherman, am continually amazed and often outraged at the willful
ignorance and dogged inconsistency I so often see among my fellows.
And like Sherman, that has often put me at odds with them. But I can
tell Sherman two things: first, political belief must bend to facts,
not the other way around, and second, in the final analysis, the truth
is a lot more comfortable than falsehood.
Thanks to Patrick for the heads-up.

123 Trapped in Chinese Coal Mine Flood; Men?
--------------------------------------------

March 31st, 2010 by Robert Franklin, Esq.
Recently I've written a couple of pieces pointing out the bizarre
unwillingness of the press to print or speak the word "man" or "men"
when reporting on deaths in war or natural or occupational disaster. I
pointed it out in the international reporting of a political slaughter
in the Philippines last year and in the New York Times reporting of
student suicides at Cornell University.

Now the same is true here in this Associated Press story on a flood in
a coal mine in China (Houston Chronicle, 3/28/10). We don't yet know
if anyone was killed, but 123 miners are trapped. Another 138 were
saved after the huge Wangjialing coal mine in Shanxi flooded. The
story also reports that coal mining in China is a disgracefully
dangerous occupation that killed 2,631 workers last year.
How many of those dead were men? How many of those who remain trapped
in the current debacle are men? The simple answer is "we don't know."
And we don't because the article, as is seemingly always the case,
doesn't tell us. My guess is that the vast majority of Chinese miners
are male and that the vast majority of the killed and injured in
Chinese mining disasters are as well. After all, mining jobs are
typically held by men and reporting on all types of disasters usually
includes the phrase "many of whom were women" to refer to victims, if
that is in fact the case. So since there's no such phrase, it's safe
to say that most or all of those trapped in the current situation and
killed last year are male. But don't rely on the article to just, you
know, state the facts.

In the AP story, those trapped are either "miners" or "people." They
are undeniably those things, but they also are men or women. If more
than a very few were women, history tells us that the article would
have said so.

Followup: Rachel Yould to Plead Guilty to Multiple Fraud Charges
----------------------------------------------------------------
March 31st, 2010 by Robert Franklin, Esq.

Back on January 6th, I reported on former Miss Anchorage and Rhodes
and Fulbright Scholar, Rachel Yould. At the time, prosecutors had
charged her with multiple counts of fraud connected to her obtaining
student loans.
But the real revelation was that the Social Security Administration
has a program under which a person can obtain a new identity, i.e. new
name and social security number if she claims to be the victim of DV
and that her abuser continues to stalk or harrass her or she's in
danger of future injury. Apparently some 14,000 people have obtained
new identities under the program, and one of them was Rachel Yould.

Prosecutors allege and, according to this article, Yould is now
prepared to admit that she used her new name, Rachel Hall, to scam
many different organizations that make student loans (Anchorage Daily
News, 3/30/10). She apparently fleeced them of hundreds of thousands
of dollars in all. Yould then used the money to fund a lavish
lifestyle, purchase a condo, start a journal, several businesses and
travel extensively. The list of her lies seems virtually endless, but
here's a small taste:
At one point, one of her identities falsely claimed $1.7 million a
year income to co-sign for a student loan to her other identity,
prosecutors said in pre-trial filings.

To maintain her status as an Oxford University student so that she
could continue to get loans, she forged documents from a Japanese
university to say she was there conducting research for her Ph.D.,
prosecutors said.
Some of her student loans funded her business, set up through a
complicated chain of offshore entities. Her employees thought the
business was part of Oxford, when in fact it was being propped up
by her loan proceeds, prosecutors said.

Now, since the origin of the whole scheme lies in her claim of DV
victimization, it will surprise few readers to learn that, after her
indictment, Yould has had a massive outpouring of support from DV
advocates saying that she's an innocent victim who was victimized a
second time by the federal indictments. In other words, the people who
never suspect a woman of lying about DV didn't suspect Yould either,
even though a U.S. Attorney thought she had enough evidence to indict
her. Prosecutor Retta-Rae Randall summed up that mindset very neatly
this way:
"Yould and her spin on events became the only source upon which
people are drawing conclusions, making diagnoses, and taking
actions. She is the sole historian," Randall wrote in a court
document.

Gee, how many times could we have said those very words in the past?
Doubtless we'll get a chance to use them again in the future.
Yould is charged with nine counts of mail fraud and one count of wire
fraud. She was scheduled to go to trial on those charges on Monday,
April 5th, but she's going to plead guilty tomorrow. Another five
counts of mortgage fraud are currently set for trial in August.

What about her original claim of DV victimization? Given that she's
going to plead guilty to the mail and wire fraud charges, we can
safely conclude that she's guilty of those, but was she a victim of
DV? Well, she apparently applied for a restraining order against
someone named Robert Hall. But beyond that, U.S. Attorney Randall
said,
the father was never charged with any crimes and Yould has never
produced medical or police records, witness statements or other
evidence that supports her story.

And if she hasn't produced them for prosecutors, it's doubtful she
produced them for the Social Security Adminstration either. That
raises the obvious question "just how little does it take to get a new
identity from the SSA?"

TN Paper Supports the Status Quo in Divorce and Custody Without
Explaining Why
---------------------------------------------------------------

March 31st, 2010 by Robert Franklin, Esq.
Here we have yet another editorial in a Tennessee newspaper opposing
the equally-shared parenting bill currently before a House
subcommittee (Memphis Commercial Appeal, 3/29/10). From the title
onward, the writer doesn't seem to have thought the matter through
very clearly. Did he/she consult a single proponent of the bill? Did
he/she read anything on the sociology or psychology of divorce and
custody? What about the history of the "best interests of the child"
standard? If so, it's not obvious.

The title of the piece is "Politicizing Child Custody." Fortunately,
if oddly, the editorial has nothing to do with that, which is wise.
After all, it would be a bit of a stretch to say that, when 84% of
child custody is granted to mothers, it's "politicizing" for fathers
to want an equal share. Was it "politicizing" for women to want to
have an equal number of medical school admissions? So, having raised
the point unwisely, I guess it's wise to then drop it.
I've said this before, and I'll do it again here. Opponents of
fathers' rights have an obligation to explain why the current system
is worth keeping. Every time equally-shared parenting comes up,
opponents scream bloody murder and raise the entirely false claim that
greater father access endangers the children. In the first place, it's
mothers who do most of the abuse and neglect of children, so maybe
greater father access would have a protective effect. But more to the
point, the anti-dad crowd is arguing for a system that has failed.
It's failed children, fathers and, I'd argue, mothers as well.
Mountains of social science show this. Opponents of shared parenting
are happy to ignore it.

And so it is with the editorial in the Memphis Commercial Appeal.
Honestly, it's as if whoever wrote it has no idea of the realities of
divorce court. Listen:
But putting time spent with the child at the top of the list of
factors in a contested case can be a sign that divorcing parents
are more concerned about settling scores than doing what's best
for the child.

Does the writer imagine for an instant that that doesn't happen now?
Do parents under the current system not put "time spent with the child
at the top of the list?" Are they never "more concerned about settling
scores?" You'd have to have just arrived from another galaxy to not
know that those happen every day in custody cases. So why do they all
of a sudden become a problem only when dads want to see their kids? If
"time spent with the child" shouldn't be "at the top of the list,"
maybe it's mothers who should get less of it.
Or how about this?

And to force judges in typical, contested divorce cases to follow
a prescribed formula on parental time that at least one of the
parents doesn't agree with could result in negative consequences
for the child.
Well, judges aren't now forced to make the standard orders, but they
do make them in the vast majority of cases. Any divorce lawyer can
recite them in his/her sleep - "mother gets primary custody, father
gets visitation every other weekend and Wednesday nights." Does the
writer truly believe that "at least one of the parents doesn't agree
with" those orders? Does he/she truly believe that those orders don't
"result in negative consequences for the child?" Here are two facts:
plenty of fathers don't agree with those standard orders and they
often harm children by denying them a relationship with their dads.
But again, according to the editorial, those aren't problems; no, it's
only a problem when dads want more.

How much research has to be done, how clear does it have to be before
these people read something germane to the topic they're writing
about?
Let me be as simple and straightforward as I can be. The current
system of primary custody for the mother and visitation for the father
is bad for all concerned. It's bad for children because they lose
connection with their fathers and their paternal extended families.
It's bad for fathers because they lose connection with their children.
They become 'Disneyland Dads' - entertainers and walking wallets. It's
bad for mothers because childcare after divorce falls almost
exclusively on them at the cost of their earnings, savings and
careers.

Those concepts are not hard to grasp. Each one is backed by huge
amounts of social science. And anyone who defends the status quo needs
to stand up and explain to the rest of us why it's worth preserving.
It's not, and the Commercial Appeal editorial once again fails to make
the case.

March 30th, 2010 by Robert Franklin, Esq.

I was happy to do a half-hour radio show on March 18th. The show is
called The Single Parent Show and is broadcast from Aliston, Ontario
on CFAO, 94.7 FM. It's hosted by Paulette MacDonald who is a long-time
supporter of fathers' rights generally and GlennSacks.com
specifically. The topic was Parental Alienation Syndrome and the
decision whether to include it in the Fifth Diagnsotic and Statistical
Manual. Here's the website for the Single Parent Show. Just scroll
down to the March 18th entry and click on it to hear the whole show.
I'm scheduled to be on again on June 10th.
Thanks to Paulette for her tireless and always cheerful support and
for helping to get the word out.

Letter to the Editor: TN Shared Parenting Bills 'Must Be Passed'
----------------------------------------------------------------

March 30th, 2010 by Robert Franklin, Esq.
This letter is in response to the blog post "SRO Crowds Hear Debate on
TN Equally-Shared Parenting Bill."

http://www.facebook.com/pages/DADS-of-Tennessee/366276263080?v=wall&ref=nf
A universal shared equal parenting law would prevent scorned women
from preventing fathers from equal parenting time. This is why laws
like HB2916 & SB2881 must be passed. 50-50 must be the starting
point...Women do not own the children. The problem is, most women are
not reasonable, especially when they see their CS pay check go out the
door to daddy's house. They want the money more than they want their
children to have a father...it's sad, but true. Please join us in the
this fight for equality, share your stories and let's work together to
change the TN laws!

Tony, Franklin, Tennessee
