There are many legislative initiatives currently being debated at the
State and Federal level that will have a direct impact on health
information professionals. NYHIMA's Legislative Committee is actively
monotoring these proposals, bills and amendments to insure that our
input and perspectives are heard and considered by the decision
makers.
KEY BILLS IN CONGRESS

S.179 Health Information Technology Act of 2009 - (NYHIMA monitoring)
S.1 "A bill to create jobs, restore economic growth, and strengthen
America's middle class through measures that modernize the nation's
infrastructure, enhance America's energy independence, expand
educational opportunities, preserve and improve affordable health
care, provide tax relief, and protect those in greatest need, and for
other purposes." - (NYHIMA monitoring)
S.RES.25 National Data Privacy Day - (NYHIMA SUPPORTS)
H.R.598 Health Information Technology for Economic and Clinical Health
Act - (NYHIMA monitoring)
H.R.461 10,000 Trained by 2010 Act - (NYHIMA SUPPORTS)

NEW YORK STATE LEGISLATIVE BILLS
A.294 Establishes standards and programs relating to the prevention
and/or reduction of the incidence of hospital acquired infections
-(NYHIMA monitoring)
A.685 Relates to access to recorded personal medical information by
individuals; allows individuals access to their recorded personal
medical records; limits any insurance institution, agent or
insurance-support organization from charging more than one dollar per
page to cover the costs incurred in providing a copy of such
information to the individual - (NYHIMA Does NOT Support)
A.1769 Prohibits insurance companies from denying or canceling life
and disability coverage based upon genetic informatin about an insured
or a family member of the insured; prohibits them from requesting
genetic information about an insured or family member of the insured -
(NYHIMA is monitoring)
A.2707 Provides for the establishment of a task force on midical
record confidentiality by the commissioner of health; such task force
shall review issues related to the disposition or transference of
medical records when a health care practitioner closes, sells or
otherwise disposes of his or her practice or when a health care
practitioner dies or abandons his or her practice - (NYHIMA Supports)
A.3787 Relates to witnesses to a health care proxy; changes the
witness requirement for the health care proxy from two adult witnesses
to one adult witness; makes an exception for persons who reside in
mental health facilities by requiring such persons to have two adult
witnesses - (NYHIMA Supports)
A.3861 Requires hospitals, including a health maintenance or similar
organization if such organization accepts patients pursuant to a
health care or insurance plan provided as a benefit to employees of
the state or of any political subdivision thereof, to maintain patient
records for a period of not less than 25 years, provided that a
hospital may, before the end of such period, dispose of records under
certain conditions - (NYHIMA Does NOT Support)
A.3977 Prohibits a health care coverage plan, including Medicaid, from
making a purchase, payment or reimbursement for treatment and/or any
other costs related to the care of a patient with a hospital acquired
infection deemed preventable by the commissioner - (NYHIMA is
monitoring)
A.4016 IRelates to HIV related testing; removes the need for a health
care provider to receive a separate written consent for the
performance of an HIV related test; requires counseling or referrals
for counseling upon the communication of a postitive test result -
(NYHIMA Supports)
A.4866 Prohibits health care providers who discontinue their practice
from charging for the transfer of patient records - (NYHIMA Supports)
A.7271 Establishes a rewards program for individuals who provide
relevant information to the office of the Medicaid Inspector General
taht leads to the detection and conviction of persons engaging in
Medicaid fraud; provides for award up to 10% of amounts recovered,
based on the relevancy and accuracy of information - (NYHIMA is
monitoring)
S.969 Provides that physician fee reimbursement under the Medicai
program for office visits be no less than the amount reimbursed for
physician treatment in hospital out-patient settings - (NYHIMA
monitoring)
S.1053 Provides that health insurance coverage may not deny
reimbursements because the registered laboratory providing laboratory
services has not been approved by the insurer or other entity;
provides that in such case the insured pays excess costs therefore
above the covered benefit - (NYHIMA monitoring)
S.2896 Directs clinical laboratories to provide results of tests
directly to the person on whom the test was performed - (NYHIMA
monitoring)
